Diritto di Recesso
Conforme all’art. 54-bis del Codice del Consumo — D.Lgs. 209/2025 e Direttiva UE 2023/2673
Dal 19 giugno 2026, il D.Lgs. 209/2025 (che recepisce la Direttiva UE 2023/2673) impone a tutti gli e-commerce di fornire una funzione digitale di recesso direttamente nell’interfaccia online. Non è più sufficiente indicare un’email o allegare un modulo nelle condizioni di vendita.

Il diritto di recesso è il diritto del consumatore di recedere da un contratto di acquisto a distanza senza dover fornire alcuna motivazione, entro il termine previsto dalla legge.
Bergasalus S.r.l. garantisce il rispetto di questo diritto in conformità al Codice del Consumo (D.Lgs. 206/2005) e alle disposizioni introdotte dal D.Lgs. 209/2025.

3 Come esercitare il recesso
- Accedi alla tua Area Personale su shop.bergasalus.com
- Vai in “I miei ordini” e seleziona l’ordine per cui vuoi recedere
- Clicca su “Recedere dal contratto qui” (disponibile per 14 giorni dalla consegna)
- Conferma la tua richiesta di recesso nella schermata successiva (doppia conferma richiesta dalla legge)
- Ricevi la ricevuta automatica via email con il numero di pratica
- Rispedisci il prodotto all’indirizzo indicato nella ricevuta entro 14 giorni
In alternativa, puoi esercitare il recesso via email a info@bergasalus.com indicando il numero d’ordine, oppure tramite il modulo di recesso standard allegato.
4 Prodotti esclusi dal recesso
AttenzioneAi sensi dell’art. 59 del Codice del Consumo, il diritto di recesso non si applica a:
- Prodotti sigillati che non possono essere restituiti per motivi igienico-sanitari e che sono stati aperti dopo la consegna
- Prodotti confezionati su misura o chiaramente personalizzati
- Prodotti che per loro natura si deteriorano o scadono rapidamente
- Prodotti audio/video sigillati o software sigillati aperti dopo la consegna

From June 19, 2026, Legislative Decree 209/2025 (implementing EU Directive 2023/2673) requires all e-commerce stores to provide a digital withdrawal function directly in the online interface. It is no longer sufficient to provide an email address or attach a form in the terms of sale.

The right of withdrawal gives consumers the right to withdraw from a distance purchase contract without providing any reason, within the legal timeframe.
Bergasalus S.r.l. guarantees this right in accordance with the Italian Consumer Code (Legislative Decree 206/2005) and the provisions introduced by Legislative Decree 209/2025.

3 How to exercise your right of withdrawal
- Log in to your Personal Area on shop.bergasalus.com
- Go to “My Orders” and select the order you wish to withdraw from
- Click on “Withdraw from the contract here” (available for 14 days from delivery)
- Confirm your withdrawal request on the next screen (double confirmation as required by law)
- Receive an automatic confirmation email with your case reference number
- Return the product to the address shown in the confirmation within 14 days
Alternatively, you may exercise your right of withdrawal by email at info@bergasalus.com, quoting your order number, or by using the standard withdrawal form below.
4 Products excluded from withdrawal
ImportantPursuant to Art. 59 of the Italian Consumer Code, the right of withdrawal does not apply to:
- Sealed products that cannot be returned for hygienic or health-related reasons and that have been opened after delivery
- Custom-made or clearly personalised products
- Products that by their nature deteriorate or expire rapidly
- Sealed audio/video recordings or sealed software that have been opened after delivery
